Service Agreement

Resource Usage Policy

Domain Registration Agreement

This agreement applies to all domains registered or transferred to MyProjectHost. By engaging in these actions, clients acknowledge and accept the terms of the Domain Registration Agreement.

Domain Reseller Agreement

The MyProjectHost Domain Reseller Agreement governs the terms for using your MyProjectHost Domain Reseller account to resell our products and services.

Content and Use Policy

Lawful Use

All services provided by MyProjectHost must only be used for lawful purposes. Any transmission, storage, or display of information or material against Indian law is strictly prohibited. This includes copyright infringement, threatening or obscene material, or anything protected by trade secrets or other laws. Users agree to indemnify MyProjectHost against any damages resulting from such unlawful use.

Prohibited Content

Certain types of content are strictly forbidden on MyProjectHost servers, including but not limited to:

  • Pirated software
  • Bulk email-related products
  • Pornography and sexually explicit material
  • Hacking or cracking related websites
  • Warez and copyrighted MP3s
  • Material illegal under Indian law

MyProjectHost reserves the right to decide what violates this policy and to remove such content without prior notice.

Copyright Infringement

MyProjectHost adheres to the applicable copyright laws and will respond to all valid reports of infringement. Inappropriate notices will not be entertained.

System Resource Usage

If an account uses excessive system resources, MyProjectHost may temporarily deactivate it. In extreme cases, we provide options for upgrading or finding a new provider, aiding our customers throughout this process.

Backups

Overview of Backup Services

MyProjectHost conducts regular backups for Shared Hosting, Reseller Hosting, and WordPress hosting accounts. However, it’s important to understand that these backups are primarily for administrative use by MyProjectHost and are not guaranteed as a fail-safe backup solution. Clients should ensure that they maintain personal backups. MyProjectHost is not liable for any loss or corruption of data and does not offer compensation for any such incidents. We strive for accuracy in our backups but cannot assume responsibility for their success or failure.

Backup Systems and Policies

Our primary backup system relies on advanced technologies distinct from the standard cPanel backup system. Clients have the opportunity to manually generate a complete backup of their account at any time. For specialized backup requests, such as those requiring manual intervention by our team, additional fees may apply. We encourage clients to consult with our Billing department for detailed pricing information.

MyProjectHost’s services are designed for active web hosting and are not intended for use as a primary data storage or backup solution. We reserve the right to remove excessive backups from your hosting account, especially those impacting the overall system performance.

File Management in Backups

MyProjectHost’s backup system supports a wide range of characters for filenames (UTF-8). However, certain characters or symbols should be avoided due to compatibility issues across different filesystems. A list of such characters is provided for reference to help minimize potential issues with your backups.

Similarly, while our system generally backs up all files and folders, there are specific types of files and folders that are excluded due to technical limitations. This list is intended to guide users in understanding the scope of our backup services.

Unsolicited Email (SPAM)

SPAM Policy

Sending unsolicited emails, or SPAM, from a MyProjectHost server or using a MyProjectHost return email address is strictly forbidden. This prohibition also extends to using SPAM to promote a site hosted on our network. MyProjectHost retains the sole discretion to determine what constitutes a violation of this policy. Violations may result in immediate deactivation of the offending sites.

For intentional SPAM activities, MyProjectHost reserves the right to charge the responsible party for cleanup and related work at a predetermined rate. To report SPAM violations, please contact our abuse department.

Support Abuse

Respectful Interaction

MyProjectHost values respectful and courteous interactions. If our staff experiences consistently rude or demeaning behavior from a client, we reserve the right to suspend or terminate the account. In severe cases, we may take legal action and provide relevant information to authorities.

Cancellations

Cancellation Process

To cancel a service, clients must submit a request through the client area. This ensures verification of identity and intent. The cancellation form helps us understand the reasons for leaving and allows for a smooth termination process.

Clients will be asked to specify the type of cancellation they prefer:

  • Immediate Cancellation: The service ends either on the same day or the following day, depending on the time of the request.
  • End of Billing Period Cancellation: The service remains active until the end of the current payment period.

Our Billing team will process the request according to the chosen method and confirm once the cancellation is complete.

 

Payments and Billing

We will provide you with at least ten (10) days’ notice of your renewal pricing before the payment due date for monthly, annual, or longer-term plans. Unless otherwise provided, MyProjectHost will automatically bill your payment method on file as it follows: 

– seven (7) days before the payment due date;
– on the payment due date (if the first payment attempt failed for any reason);
– three (3) days after the payment due date (if the second payment attempt failed for any reason).

You expressly acknowledge, agree, and authorize us to automatically bill the applicable fee and/or charge your credit card or other payment methods on file for each Renewal Term, unless you terminate or cancel the Services prior to such charge as provided in this section. All fees are billed in United States Dollars (“USD”) and are subject to change with prior notice to you.

MyProjectHost is only able to automatically collect payments from customers with credit cards stored on file. All other payment methods (e.g. Razor Pay one-time payments) must be initiated manually by you. It is your responsibility to ensure that all fees are paid no later than their payment due date.

As a customer of MyProjectHost, it is your responsibility to ensure that all billing information on file with MyProjectHost is accurate and that any credit card or other automated payment method on file has sufficient funds for processing. You are solely responsible for any and all fees charged to your payment method by the issuer, bank, or financial institution including, but not limited to, membership, overdraft, insufficient funds, and over the credit limit fees. MyProjectHost screens all orders for fraud. In certain cases, if your account is flagged for fraud, your order will not be processed. MyProjectHost has no liability for not providing Services, including third-party services if your account fails the fraud screen.

Price Change

MyProjectHost reserves the right to change prices or any other charges at any time. We will provide you with at least thirty (30) days’ notice before charging you with any price change on any annual or longer-term plans. It is your sole responsibility to periodically review pricing on our website and billing information provided by MyProjectHost through the client area or through other methods of communication, including notices sent or posted by MyProjectHost.

Late Payments

Any account not paid in full by the end of the Term will be given a one (1) day grace period. If payment is not made within the one (1) day grace period, MyProjectHost reserves the right to suspend your Services. MyProjectHost reserves the right to terminate Services four (4) days after the payment due date (Shared Hosting, WordPress Hosting, Reseller Hosting) and three (3) days after the payment due date (VPS Hosting). 

MyProjectHost is not responsible for any damages or losses (including any data) as a result of suspension or termination for non-payment of your account. In addition, MyProjectHost reserves the right to refuse to reactivate your Services until any and all outstanding invoices have been paid in full.

Duplicate Payments

A “duplicate payment” is identified as any payment made more than once by a customer for a service, either inadvertently or due to system errors, utilizing a credit/debit card or via Razor Pay. Common instances of such occurrences (but not limited to) involve active Razor Pay subscriptions where a customer attempts a manual payment ahead of the automatic razor Pay subscription.

Automatic Credit

Upon detection of a duplicate payment by our system, the excess amount is automatically allocated to the customer’s MyProjectHost account as account credit, pending further action or notice by the customer.

Refund Options

In the event of a duplicate payment, you are presented with two options:

1) Full Refund as Account Credit:

You are entitled to a complete refund of the duplicate payment, which will be credited to your MyProjectHost account. This credit is applicable to any future purchases or active services with MyProjectHost.

2) Partial Monetary Refund:

Alternatively, you may opt for a partial refund of the duplicate payment. In this scenario, transaction fees imposed by the payment gateway will be retained by MyProjectHost, and the remaining balance will be refunded to your original mode of payment.

Notification Period

You are required to inform MyProjectHost of any duplicate payment within a period of fourteen (14) days from the payment date.

Should MyProjectHost be notified of a duplicate payment beyond the 14-day period, the option for a monetary refund will no longer be available. The duplicate amount will remain as a credit in your MyProjectHost account.

Money-Back Guarantee and Refund Policies

Duration and Scope of Guarantee:

45-Day Money-Back Guarantee is applicable exclusively to: Shared Web Hosting, Reseller Hosting, and WordPress Hosting.

7-Day Money-Back Guarantee is restricted solely to: VPS Hosting.

The countdown to the end of the guarantee begins from the activation date of the account, not the order placement date.

Exceptions to the Guarantee:

The Money-Back Guarantee does not extend to:

– Add-on services: Dedicated IP address, SSL Certificate, SiteLock Website Security, SpamExperts E-mail Services, Margetgoo SEO Services, WHMCS Licence, LiteSpeed Web Server Licence, cPanel Licence, CloudLinux Licence, Imunify360 License, Cloud Remote Backup, MailChannels Outbound Email Filtering, Block Storage, Disk Space Add-on, Turbo+ Boost Add-on, Resources Boost Add-on, Inodes Add-on;

– Account funds;

– Domain reseller funds;

– Domain registration, domain transfer, or domain name ID Protection;

– Paid support or migration services.

Renewal of services of any type does not fall under the ambit of the guarantee.

If there’s any breach of our Terms of Service, Service Agreement, or other policies, the Money-Back Guarantee stands null and void.

General Refund Policies:

After the Money-Back Guarantee period, MyProjectHost upholds a no-refund policy.

Any credits applied to MyProjectHost accounts are non-refundable. They remain active for two (2) years after terminating the last hosting account. Failure to utilize the credit within this period results in forfeiture, with no liabilities falling on MyProjectHost.

Only first-time accounts are eligible for a refund. For example, if you’ve had an account with us before, canceled, and signed up again, or if you have opened a second account with us, you will not be eligible for a refund. The same policy applies if you purchase a second service similar to one that is already active in your account. Violations of this Agreement will waive your rights under the refund policy. 

Introductory Offer Eligibility

Introductory Offers (“Introductory Offers”) are provided by MyProjectHost to encourage the launch of new websites on our platform. These offers are accessible to both new customers creating a new account and existing customers commencing a new and separate project (“New Website”).

Introductory Offers are designed to facilitate and support the growth of new initiatives by providing an advantageous starting rate. Existing customers may avail themselves of these Introductory Offers only when setting up a New Website distinct from any other project or service currently active in their account.

Existing websites (“Existing Websites”) that are already hosted under an existing customer’s account are not eligible for Introductory Offers. These projects must adhere to the standard or renewal pricing applicable at the time of service continuation or upgrade.

To maintain equity and the integrity of our promotions, existing customers may not transfer or re-register an Existing Website into a new account or under a new project for the purpose of claiming Introductory Offers.

In the event of such a violation, the offending account(s) may be subject to immediate suspension or termination, and any transactions associated with the violation will not be eligible for a refund, including but not limited to refunds within the standard 7 or 45 day money-back guarantee period offered by MyProjectHost.

Introductory Offer Eligibility

Encouraging New Projects

MyProjectHost provides Introductory Offers to encourage the development of new websites and projects on our platform. These offers are available to:

New customers creating a new account.
Existing customers starting a distinct new project or website.

Scope and Limitations

The purpose of these offers is to support the launch of new initiatives with a favorable starting rate. They are only applicable for setting up new websites that are different from any other projects or services in an existing account. Existing websites already hosted with MyProjectHost are not eligible for these offers and must follow standard or renewal pricing.

To ensure fairness in our promotions, customers cannot transfer or re-register an existing website into a new account to claim these offers. Violation of this policy may lead to immediate suspension or termination of the account, and any associated transactions will not be eligible for a refund, including within the standard 7 or 45-day money-back guarantee period.

Free Migration Policies

Migration Assistance

MyProjectHost offers migration assistance as a courtesy service. While we strive to accommodate all migration requests, we cannot guarantee the feasibility or time required for each migration. This is due to the varied configurations and data formats used by different hosting companies.

Free migration is available for 60 days from your sign-up date. Beyond this period, migrations may incur charges. Please contact our Support team for pricing. MyProjectHost is not responsible for any lost or missing data during the migration process. It is crucial to back up your data before initiating a transfer.

Free Domain Name Policies

Domain Offers for Long-Term Plans

Customers who opt for 36-month hosting plans are eligible for a complimentary domain registration for one year or a free domain transfer.

Domain Registration: This offer applies to select extensions and is available for new customers at the time of sign-up. Post the first year, domain renewal follows standard rates.
Domain Transfer: Eligible for specific extensions and must be claimed within 30 days of hosting plan activation. The existing domain expiration will extend by one year, after which standard renewal rates apply.

Cancellation within the 7/45 Day Money Back Guarantee period results in a refund minus the prevailing rate for domain registration or transfer.

Prohibited Persons Policy

Compliance with International Laws

In adherence to U.S. and international export and control laws and sanctions, certain individuals and entities are prohibited from using our services. This includes entities or individuals from sanctioned countries or regions, or those listed as Specially Designated Nationals (SDN) by the Office of Foreign Assets Control (OFAC). MyProjectHost does not provide services for any Country-Code Top Level Domain Name (ccTLD) associated with sanctioned countries or regions.

Policy Adherence and Consequences

Account Suspension and Termination

Failure to comply with MyProjectHost policies may lead to account suspension or termination without prior warning. Our standard approach is a warning first, followed by account deactivation for subsequent offenses. However, immediate action may be taken depending on the severity of the breach. MyProjectHost reserves the right to remove any content or accounts deemed unacceptable or in violation of our policies.
